Privacy Policy

This Privacy Policy explains how GroupUnlock and its operator, Smartstack Platforms LLC (“GroupUnlock,” “we,” “us,” or “our”), collect, use, disclose, retain, and protect personal information when you use GroupUnlock websites, campaign pages, creator tools, accounts, payment-related functionality, communications, and related services (collectively, the “Platform”).

This Policy applies to visitors, buyers, campaign participants, Creators, account holders, and other individuals who interact with GroupUnlock.

By using the Platform, you acknowledge the practices described in this Privacy Policy.

1. Who We Are

GroupUnlock is a software platform operated by Smartstack Platforms LLC.

GroupUnlock enables businesses, creators, organizations, and other sellers (“Creators”) to operate group-pricing campaigns in which buyers may make commitments, save payment methods, participate in price milestones, and complete purchases based on campaign results.

For privacy questions concerning GroupUnlock itself, you may contact us using the information in the “Contact Us” section below.

For information collected directly by a third-party Creator in connection with that Creator’s own products, services, fulfillment, or independent marketing, that Creator may also be responsible for its own privacy practices.

2. Information We Collect

The information we collect depends on how you use GroupUnlock.

A. INFORMATION YOU PROVIDE DIRECTLY

We may collect information such as:

  • name;
  • email address;
  • phone number;
  • business or company name;
  • account login information;
  • profile information;
  • Creator business information;
  • campaign information;
  • campaign content;
  • support requests;
  • messages or communications sent to us;
  • preferences;
  • transaction-related information;
  • selected campaign plan or offer;
  • commitment and authorization information;
  • refund or dispute information; and
  • other information you voluntarily provide.

B. CAMPAIGN PARTICIPATION INFORMATION

When you participate in a GroupUnlock campaign, we may collect and maintain information such as:

  • the campaign you joined;
  • the date and time of your commitment;
  • selected plan or purchase option;
  • applicable maximum authorization;
  • consent records;
  • campaign status;
  • payment setup status;
  • final campaign price;
  • payment status;
  • withdrawal or cancellation status;
  • campaign eligibility status;
  • fulfillment or access status; and
  • relevant timestamps.

We maintain these records to operate the campaign accurately, document consent, prevent duplicate or fraudulent activity, process transactions, provide support, and meet legal or accounting obligations.

C. CREATOR INFORMATION

When you use GroupUnlock as a Creator, we may collect information including:

  • name;
  • contact details;
  • business name;
  • business profile;
  • business logo or images;
  • support details;
  • campaign details;
  • offer descriptions;
  • pricing;
  • refund policies;
  • fulfillment terms;
  • connected payment account information;
  • transaction and payout information;
  • fee-plan information; and
  • other information necessary to operate your Creator account.

D. DEVICE AND USAGE INFORMATION

When you access the Platform, we may automatically receive certain technical information, including:

  • IP address;
  • browser type;
  • device type;
  • operating system;
  • referring page;
  • pages or features accessed;
  • dates and times of access;
  • approximate geographic region derived from IP address;
  • interaction and navigation information;
  • error logs;
  • security events; and
  • similar technical information.

We may use this information for security, diagnostics, fraud prevention, performance, analytics, and product improvement.

3. Information We Receive From Other Sources

We may receive information from third parties that help us operate GroupUnlock, including:

  • payment processors;
  • authentication providers;
  • hosting providers;
  • database providers;
  • email delivery providers;
  • analytics providers;
  • fraud-prevention and security providers;
  • Creators using the Platform; and
  • other vendors supporting our services.

For example, a payment processor may provide us with limited payment-related information such as:

  • payment status;
  • customer identifier;
  • payment method identifier;
  • card brand;
  • last four digits of a card;
  • payment or setup status;
  • dispute information; and
  • transaction identifiers.

We use information received from third parties only as reasonably necessary to provide and protect the Platform or for other purposes described in this Policy.

4. Payment Information

GroupUnlock uses third-party payment processors, including Stripe, to securely handle payment information.

GroupUnlock does not intentionally collect or store complete payment card numbers or card security codes on its own servers.

Payment information is entered into and handled by the applicable payment processor.

GroupUnlock may receive and retain limited payment-related information needed to operate the Platform, including:

  • Stripe customer IDs;
  • Checkout Session IDs;
  • SetupIntent IDs;
  • PaymentMethod IDs;
  • PaymentIntent or transaction IDs;
  • card brand;
  • last four digits;
  • payment status;
  • whether a payment method was successfully saved;
  • payment failure information;
  • refund information; and
  • dispute information.

For campaigns using GroupUnlock’s save-now, charge-later model, a payment method may be securely saved with the payment processor for a later authorized charge in accordance with the campaign terms accepted by the buyer.

Payment processors operate under their own privacy policies and terms.

5. How We Use Information

We may use personal information to:

  • provide and operate GroupUnlock;
  • create and manage accounts;
  • operate campaign pages;
  • accept and manage buyer commitments;
  • calculate campaign eligibility and group pricing;
  • securely coordinate payment setup;
  • process authorized payments;
  • process refunds;
  • administer Creator plans and fees;
  • provide Creator tools;
  • enable fulfillment;
  • communicate transaction and campaign information;
  • send receipts and confirmations;
  • provide customer support;
  • respond to inquiries;
  • maintain consent and authorization records;
  • detect and prevent fraud;
  • protect account and Platform security;
  • investigate disputes;
  • enforce our Terms of Service;
  • comply with legal requirements;
  • maintain accounting and transaction records;
  • monitor and improve Platform performance;
  • develop new features;
  • understand how users interact with the Platform;
  • prevent misuse;
  • maintain service reliability; and
  • send marketing communications where permitted and appropriately consented to.

We may also use aggregated or de-identified information that does not reasonably identify an individual for analytics, product development, research, business planning, or similar legitimate purposes.

6. Creator Campaigns and Buyer Information

When a buyer participates in a campaign operated by a third-party Creator, GroupUnlock may provide that Creator with information reasonably necessary to manage and fulfill the campaign.

This may include information such as:

  • buyer name;
  • email;
  • phone number where appropriate;
  • business name where provided;
  • selected offer;
  • final purchase amount;
  • payment status;
  • fulfillment status; and
  • relevant campaign participation information.

Creators may use this information to:

  • fulfill purchases;
  • communicate with buyers;
  • provide products or services;
  • deliver account or access information;
  • respond to support requests;
  • administer refunds;
  • meet legal or tax obligations; and
  • carry out other activities reasonably related to the purchased offer.

Creators must use buyer information lawfully and in accordance with the GroupUnlock Terms of Service.

A Creator must not use buyer information for unrelated marketing where applicable law requires separate consent and that consent has not been obtained.

Creators are responsible for their own independent privacy obligations when they use buyer information outside GroupUnlock’s direct operation of the Platform.

If you have a privacy question concerning how a particular Creator uses your information after receiving it, you should contact that Creator directly.

7. How We Share Information

We do not sell personal information for money.

We may disclose personal information in the following circumstances.

A. CREATORS

We may provide buyer information to the Creator responsible for a campaign as described above.

B. SERVICE PROVIDERS

We may share information with vendors that help us provide the Platform, such as providers of:

  • payment processing;
  • cloud hosting;
  • databases;
  • email delivery;
  • authentication;
  • analytics;
  • security;
  • fraud prevention;
  • customer support;
  • infrastructure monitoring; and
  • other technical services.

These providers receive information only as reasonably necessary to perform services for us and are subject to their applicable contractual and legal obligations.

C. PAYMENT PROCESSORS

We share transaction-related information with Stripe and other payment providers as necessary to:

  • save payment methods;
  • process authorized charges;
  • issue refunds;
  • manage disputes;
  • operate connected accounts;
  • prevent fraud; and
  • comply with financial regulations.

D. LEGAL AND SAFETY PURPOSES

We may disclose information where we reasonably believe it is necessary to:

  • comply with law, regulation, subpoena, court order, or legal process;
  • respond to lawful requests from authorities;
  • investigate fraud;
  • protect the rights, property, or safety of GroupUnlock, users, or others;
  • enforce our agreements;
  • protect Platform security; or
  • prevent unlawful activity.

E. BUSINESS TRANSACTIONS

Information may be disclosed as part of a merger, acquisition, financing, restructuring, sale of assets, or similar business transaction, subject to applicable law.

F. WITH YOUR DIRECTION OR CONSENT

We may disclose information when you direct us to do so or otherwise provide appropriate consent.

8. Cookies and Similar Technologies

GroupUnlock may use cookies, local storage, pixels, session technologies, and similar tools to:

  • keep users signed in;
  • remember preferences;
  • maintain session state;
  • protect accounts;
  • prevent fraud;
  • measure Platform usage;
  • understand performance;
  • diagnose errors; and
  • improve the Platform.

Some service providers may also place or access cookies or similar technologies when providing services to GroupUnlock.

Where legally required, we will provide appropriate choices or consent mechanisms for non-essential cookies.

Browser settings may allow you to block or delete cookies, although doing so may cause some Platform features to function incorrectly.

GroupUnlock does not currently sell personal information for money.

If GroupUnlock later engages in advertising or tracking practices that legally constitute a “sale,” “sharing,” or targeted advertising under applicable privacy law, we will provide any legally required notices and opt-out controls.

9. Marketing Communications

We may send promotional or marketing emails when permitted by law.

You may unsubscribe from marketing emails using the unsubscribe link included in those messages or by contacting us.

Even if you unsubscribe from marketing communications, we may continue to send necessary transactional or service communications, such as:

  • commitment confirmations;
  • campaign notices;
  • payment updates;
  • receipts;
  • account-security messages;
  • fulfillment notices;
  • important service changes; and
  • legally required notices.

A Creator may separately send marketing communications if the Creator has the necessary legal basis or consent to do so.

10. SMS and Phone Communications

If GroupUnlock requests consent to receive marketing or promotional SMS messages, that consent is optional unless clearly stated otherwise.

We will not treat consent to marketing SMS as a condition of purchasing an offer unless legally permitted and clearly disclosed.

Transactional messages may be used where appropriate to communicate information related to:

  • account security;
  • campaign participation;
  • payment status;
  • fulfillment;
  • support; or
  • other requested services.

Message and data rates may apply.

Users may opt out of promotional SMS communications through the method stated in the applicable message or consent disclosure.

We do not authorize Creators to use phone numbers obtained through GroupUnlock for unrelated promotional SMS campaigns without any consent required by applicable law.

11. Data Retention

We retain personal information for as long as reasonably necessary to:

  • provide the Platform;
  • maintain user accounts;
  • operate and document campaigns;
  • fulfill transactions;
  • maintain consent and authorization records;
  • resolve disputes;
  • comply with legal, accounting, and tax requirements;
  • prevent fraud;
  • enforce agreements; and
  • protect our legal rights.

Different categories of information may be retained for different periods.

For example, transaction, authorization, consent, tax, refund, and dispute records may need to be retained after an account is closed.

When information is no longer reasonably necessary, we may delete, anonymize, or de-identify it, subject to applicable law and operational requirements.

12. Security

We use reasonable administrative, technical, and organizational measures designed to protect personal information against unauthorized access, loss, misuse, alteration, or disclosure.

These measures may include:

  • access controls;
  • authentication;
  • restricted administrative access;
  • encryption in transit;
  • secure cloud infrastructure;
  • payment tokenization;
  • logging;
  • monitoring;
  • least-privilege access practices; and
  • third-party payment security controls.

No system can guarantee absolute security.

You are responsible for protecting your account credentials and should notify us if you believe your account or information has been compromised.

13. Your Privacy Rights

Depending on where you live and applicable law, you may have rights concerning your personal information.

These rights may include the right to:

  • request access to personal information;
  • request correction of inaccurate information;
  • request deletion;
  • request a copy of certain information;
  • object to or restrict certain processing;
  • withdraw consent where processing is based on consent;
  • opt out of certain marketing;
  • opt out of certain targeted advertising, sales, or sharing where applicable;
  • request information about categories of information disclosed; and
  • appeal certain privacy-rights decisions where applicable.

Privacy rights are not absolute and may be subject to legal exceptions.

For example, we may need to retain transaction or consent records even after a deletion request where legally required or reasonably necessary to protect legal rights.

We may need to verify your identity before fulfilling a request.

Where permitted by law, an authorized agent may submit a request on your behalf, subject to appropriate verification.

We will not discriminate against you for exercising privacy rights provided by applicable law.

14. U.S. State Privacy Rights

Residents of certain U.S. states may have additional privacy rights under applicable state law.

Depending on the law and whether it applies to GroupUnlock, these may include rights to:

  • know the categories of personal information collected;
  • know the purposes for collecting or using personal information;
  • request access;
  • request correction;
  • request deletion;
  • obtain a portable copy;
  • opt out of certain sales or sharing;
  • opt out of targeted advertising;
  • limit certain uses of sensitive personal information; or
  • appeal a denied request.

GroupUnlock does not sell personal information for money.

We also do not knowingly use personal information for cross-context behavioral advertising unless specifically disclosed.

If our practices change in a way that creates additional legal opt-out rights, we will provide the required controls.

Where recognized and technically applicable to our practices, we may honor browser-based privacy preference signals such as Global Privacy Control as required by law.

15. International Users

GroupUnlock is operated from the United States.

If you access the Platform from another country, your personal information may be transferred to, stored in, or processed in the United States or other locations where GroupUnlock or its service providers operate.

Those countries may have data-protection laws different from those in your country.

Where applicable law requires safeguards for international transfers, we will use legally recognized mechanisms or other appropriate protections.

Individuals in jurisdictions such as the European Economic Area, United Kingdom, or other regions with comprehensive privacy laws may have additional rights regarding their personal information.

Where required, GroupUnlock will process personal information based on an appropriate legal basis, which may include:

  • performance of a contract;
  • legitimate interests;
  • compliance with legal obligations; or
  • consent.

16. Children’s Privacy

GroupUnlock is intended for adults and business users.

The Platform is not directed to children under 13, and we do not knowingly collect personal information from children under 13.

Users must be at least 18 years old to enter into commitments, make purchases, or operate Creator accounts unless otherwise expressly permitted under applicable law.

If we learn that personal information was collected from a child in violation of applicable law, we will take reasonable steps to delete it.

17. Third-Party Services and Links

The Platform may contain links to or integrations with third-party services.

These may include services provided by:

  • Stripe;
  • Creators;
  • social networks;
  • external websites;
  • email providers;
  • video providers;
  • scheduling services; or
  • other third parties.

Those services have their own privacy practices.

This Privacy Policy does not govern information collected directly by third parties outside GroupUnlock’s control.

You should review the privacy policy of any third-party service you use.

18. Business Transfers

If GroupUnlock or Smartstack Platforms LLC is involved in a merger, acquisition, financing, reorganization, bankruptcy, sale of assets, or transfer of all or part of the business, personal information may be transferred as part of that transaction.

Any successor will be subject to applicable law regarding the personal information it receives.

19. Changes to This Policy

We may update this Privacy Policy from time to time.

When we make material changes, we may provide notice by:

  • updating the “Last Updated” date;
  • posting a notice on the Platform;
  • sending an email; or
  • using another reasonable method.

Changes become effective when stated in the updated Policy.

We encourage users to review this Policy periodically.
